Unsigned contracts
Unsigned contract: Does that mean there’s no contract?
Not necessarily.
In our latest scenario, Jamie starts work, receives her wages, attends training and carries out her duties - but never returns her signed contract.
So what happens?
An employment contract doesn’t necessarily depend on a signature. Where an employee continues working, accepts pay and benefits, and doesn’t challenge the terms, acceptance can potentially be demonstrated through their conduct.
Key takeaway:
Don’t assume an unsigned contract means there is no contractual relationship.
For employers, it’s good practice to follow up in writing when contracts aren’t returned and keep a record of those reminders.
