Written reasons for dismissal


Are all employees entitled to receive a written statement of reasons for their dismissal?

In Jersey, at present, an employer is not normally under any obligation to provide a dismissed worker with a written reason for their dismissal. Many employers consider it good practice to do so as a matter of course.

Bearing in mind that under the Employment Law 2003 an employee may take a complaint to the Tribunal and it is then for the employer to show that the principle reason(s) for the dismissal was fair, it can be seen that it is good practice to give a written statement of reasons for dismissal, regardless of the employee’s length of service.
