Bullying and Harassment at Work
Jersey is still going through a major transition in terms of employment legislation. The law relating to unfair dismissal (the Employment Law 2003) came into effect on 1st July 2005. Numbers of claims of Constructive Unfair Dismissal have arisen because an employee has alleged that his/her employer has not provided effective protection against bullying and harassing behaviour.
This course is designed to alert employers and employees to the implications of the legislation in terms of their current and future procedures. The course will allow you to benchmark your existing policies and procedures against best practice and ensure they comply with existing and future legislation.
Bullying and Harassment Policies
Appropriate bullying and harassment policies and procedures are key to avoiding constructive unfair dismissal and/or severe psychological damage to an employee that could result in a substantial compensation claim via the Royal Court. When inappropriate behaviour is reported in the workplace, the best outcome possible is that the matter is dealt with quickly and, above all, fairly.
Good procedures to deal with bullying and harassment are important. They provide a mutually beneficial framework for the employment relationship; encourage improvements in individual conduct; allow employees to raise appropriate concerns; make for well-ordered employee relations.
By the end of the program you will:
- Understand more fully what constitutes bullying and harassment.
- Recognise the risks that such behaviour poses to the organisation and to the individual (the victim).
- Understand how the issues relate to legislation on unfair dismissal
- Appreciate the importance of having formal procedures for dealing with bullying and harassment, including appropriate investigation.
- Understand the benefits to both employer and employee
- Be able to design and implement and work with procedures that are appropriate to your organisation
- Ensure that fairness and consistency are features of your procedures and that they are operated properly
- Review existing workplace procedures and policies in the light of best practice and current and future legislation
The session is participative and uses a comprehensive DVD as well as case studies to illustrate key aspects of the learning.
