Update on Employment Law and Employment Relations Law

The Employment (Jersey) Law 2003 received States approval on 8th July 2003 and came into effect on 1st July 2005. A number of amendments have been made and the Tribunal has set a number of precedents. The Employment Relations(Jersey) Law 2005 came into effect in autumn 2007.

The main provisions of the Employment Law are:

  • Written Statements of Employment Particulars
  • Minimum Rest Periods and Annual Leave
  • Minimum Wage
  • Payment of Wages
  • Termination of Employment
  • Unfair Dismissal
  • Redundancy payments
  • Supplementary Information
  • The Tribunal

The main provisions of the Employment Relations Law are:

  • The Recognition of Trade Unions
  • Resolving Collective Disputes
  • Balloting and Conduct in Employment Disputes

By the end of this training course you will: 

  • Appreciate the new elements introduced into the employment relationship by the Employment (Jersey) Law 2003 and the Employment Relations (Jersey) Law 2005.
  • Understand any differences compared to previous legislation and updates since the new law was introduced
  • Understand the issues surrounding the employment of fixed term contact staff, temporary staff, permanent staff and agency workers
  • Understand the Tribunal process and those actions, or inactions, which could result in a Tribunal Hearing. 
  • Appreciate the impact of changes that have been made

We do not intend to deliver a "clause by clause" explanation of the law, but to ensure that you have a working knowledge of its provisions. We do expect to use a number of case studies during the training session.
